Hello, I noticed your plight trying to retag this image to satisfy the automatic deletion tag. Part of the problem is it cannot be both public domain and non-free fair use. They're total opposites.

  • If it's fair use, it must have a valid fair use rationale in addition to a license tag (and be used in at least one article (not user page) or it will still get deleted after a one week grace period).
  • If you legally own the rights to the logo and are happy to release it under a free license, such as into the public domain, you should clean up the other tags such as "non-free logo".

Have at a look at Wikipedia:Image copyright tags/All, for the full list of free and non-free license tags you can use, such as the Creative Commons attribution licenses.
In any case, any condition of "permission had been granted for use on wikipedia" or similar, is problematic as it's contradictory to the license tags. Either remove such conditions or let the file be deleted. • Anakin (talk) 12:53, 25 October 2009 (UTC)[reply]

I've gone ahead and deleted the image for now due to the unclear copyright status of the image. Fair use and public domain are mutually exclusive. One cannot also be the other. Fair use rationale for File:KittiwakesBand.jpg

Thanks for uploading or contributing to File:KittiwakesBand.jpg. I notice the image page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in Wikipedia articles constitutes fair use. In addition to the boilerplate fair use template, you must also write out on the image description page a specific explanation or rationale for why using this image in each article is consistent with fair use. Suggestions on how to do so can be found here.

Please go to the image description page and edit it to include a fair use rationale. Using one of the templates at Wikipedia:Fair use rationale guideline is an easy way to ensure that your image is in compliance with Wikipedia policy, but remember that you must complete the template. Do not simply insert a blank template on an image page.
