Replaceable fair use File:Lester Brickman portrait 2009.jpg

Thanks for uploading File:Lester Brickman portrait 2009.jpg. I noticed that this file is being used under a claim of fair use. However, I think that the way it is being used fails the first non-free content criterion. This criterion states that files used under claims of fair use may have no free equivalent; in other words, if the file could be adequately covered by a freely-licensed file or by text alone, then it may not be used on Wikipedia. If you believe this file is not replaceable, please:

  1. Go to the file description page and add the text {{di-replaceable fair use disputed|<your reason>}} below the original replaceable fair use template, replacing <your reason> with a short explanation of why the file is not replaceable.
  2. On the file discussion page, write a full explanation of why you believe the file is not replaceable.

Alternatively, you can also choose to replace this non-free media item by finding freely licensed media of the same subject, requesting that the copyright holder release this (or similar) media under a free license, or by creating new media yourself (for example, by taking your own photograph of the subject).

  • I saw that you left a polite request on {Hullablloo Wolfowitz's talk page. I think you were asking where to put what we call the "fair use rationale".
  • While HB's answer was technically correct, I don't think it was a helpful answer to your question. Instead he or she informed you of how Brickman could write to the committee that handles confidential correspondence to establish an image was being used with appropriate permissions to alow it to be freely distributable. This is not an answer to your question about how to compliantly make use of non-free images.
  • The project has a standard form for uploading images. It helps the uploader fill out a standard template we use for images. The wikipedia has a narrow set of rules as to when we can make fair use of non-free images, described at WP:NFCC. A second set of templates, {{Non-free use rationale}} and {{Non-free fair use in}}, are used for those images that do comply with NFCC. When properly filled out those templates supply the explanation as to why that non-free image measures up to NFCC.
  • Why is the wikipedia so strict with its extra restrictions on fair use images? I can't answer that. I can tell you what those who zealously enforce these rules say... They say that the wikipedia can't use fair use images, because our end users could re-use those images in ways that violate the intellectual property rights of the original photographers. But we trust our end users to re-use images licenced under the creative commons or gfdl. If our end-users don't comply, we see that as their responsibility. None of the people who zealously enforce our extra restrictions on re-using images undr existing fair use laws has ever been able to explain why we can't trust our end users to re-use fair use images responsibly.

    • Can you check the little photo I uploaded? Brickman, and three other experts, appeared on a panel with George W. Bush, in 2005. Unlike all other nations US law makes works of its Federal government, including the President's photographers, public domain. Did I select the correct panelist? Is that Brickman?
    • I am sorry it is such a tiny picture, and doesn't show him face-on. But I think that, since a public domain picture of him exists, no fair use image will be agreed to...

      • Thanks for your reply. Yes, leaving me a note on User talk:Geo Swan works. Most people would leave their reply here, following the original. An asterisk, colon, or octothorp, is a markup character, that causes the reply to be indented. You can put a {{ping|Joe Blow}} in any comment, and Joe Blow gets a heads-up the next time they log in.

I am sorry that your attempts to use an image Dr Brickman specifically approved was made more complicated than necessary.
The instructions at Commons:OTRS explain how Dr Brickman would send a letter to permissions-commons@wikimedia.org. An example letter is found at Commons:OTRS#E-mail template for release of rights to a file.
