Rules vary widely, but most research on unvaccinated/undervaccinated students focuses on exemptions rather than provisional status. Time to cure can range from days to over a year. Differences in follow up, consequences for noncompliance.


According to the Amended Complaint, the Plaintiffs who received the vaccine suffered the mental anguish of being coerced into violating their religious beliefs and incurred an “increased risk for death, blood clots, heart attacks, strokes, myocarditis and other severe injuries or illnesses known and unknown that are now being attributed to the vaccine.” (Id. ¶¶ 66, 153). While such injuries may exist, they are not related to Plaintiffs' “compensation, terms, conditions, or privileges of employment[.]” 42 U.S.C. § 2000e-2(a)(1). "Covid vaccine passports" introduced in Northern Ireland during the pandemic were lawful, judges have ruled. The Court of Appeal said the Covid certification scheme was a proportionate and legitimate response to the pandemic's impact on the health system. The passports were required to enter restaurants, bars and cinemas. Judges rejected claims this was a violation of civil liberties for unvaccinated people. Plaintiff Justin Hart, a California resident, is suing Defendants Facebook Inc., Twitter Inc., President Joseph Biden, Surgeon General Vivek Murthy, the Department of Health and Human Services (HHS), and the Office of Management and Budget (OMB). See Compl. (dkt. 1). Hart alleges that, between late 2020 and mid-2021, Facebook and Twitter flagged his posts as misinformation about COVID-19 and suspended or locked his accounts. Hart contends that these acts violated the First Amendment of the United States Constitution because President Biden and Surgeon General Murthy (collectively, Federal Defendants) allegedly acted jointly with Facebook and Twitter. Hart also argues that Facebook and Twitter violated the Free Speech Clause of the California Constitution as well as California contract and tort law.[1] Facebook, Twitter, and the Federal Defendants move to dismiss. Facebook and Twitter also move to strike under California's anti-SLAPP statute. Finding oral argument unnecessary, the Court GRANTS the motions to dismiss without leave to amend.

Customer requests

Service providers are finding it increasingly common to have customers inquire about the vaccination status of employees who might deal with those customers, or to have customers specifically request that only vaccinated workers be permitted to enter their homes or businesses, or otherwise work in physical proximity to the customer.

This afternoon I learned that I will be speaking on Vaccine Law matters for the American Society of Law, Medicine & Ethics (ASLME), at their 45th Annual Health Law Professors Conference in June.


Complicating pandemic response, these questions have taken on a political dimension. In democracies with political parties seeking to sway potential voters, there is a strong incentive for minority parties to criticize and diminish whatever measures have been taken by the governing party or parties to address the crisis. To a degree not seen in previous times, this now encompasses potentially embracing anti-vaccine advocacy and misinformation for the purpose of obtaining the support of citizens inclined towards those views. Even in non-democratic governments, forces opposing ruling powers similarly have an incentive to criticize pro-vaccination governmental responses.

In the 2023 case of Cole v. Grp. Health Plan, plaintiff, a physical therapist, received a religious exemption from COVID-19 vaccination. Her company provided orange badges to fully vaccinated employees, and required unvaccinated employees to be masked at all times, while fully vaccinated employees can remove their masks in various circumstances. Plaintiff asserted religious discrimination on the grounds that she was singled out for disparate treatment on the basis of her religious beliefs. The court found that there was no adverse employment, action, because wearing a mask, and not receiving a badge were concededly, not in conflict with plaintiffs religious beliefs, and she was not otherwise hampered in the execution of her job duties.

    • Mayo adopted a vaccine policy (the “Policy”) that required its employees to receive the COVID-19 vaccination, receive an exemption from the vaccine requirement, or be terminated from their positions. Plaintiffs identify as Christians and allege they refused the vaccine based on their sincerely held religious beliefs. Plaintiffs Ihde and Rubin were each granted religious exemptions from the vaccine mandate but refused to comply with the Policy's requirement that they undergo consistent COVID-19 testing. Plaintiffs Kiel, Miller, and Ringhofer were all denied religious exemptions and refused vaccination. Mayo consequently terminated all five Plaintiffs. Plaintiffs then initiated this action against Mayo pursuant to Title VII, the Minnesota Human Rights Act (“MHRA”), the Americans with Disabilities Act (“ADA”), and for breach of contract and promissory estoppel.

    • The Eighth Circuit has explicitly stated that termination is a “discrete act,” not a continuing violation. See Hutson v. Wells Dairy, Inc., 578 F.3d 823, 826 (8th Cir. 2009) (citing Morgan, 536 U.S. at 114) (“A termination is a discrete act, not a continuing violation.”). Accordingly, Plaintiffs Ihde and Miller needed to exhaust their administrative remedies based on the alleged unlawful termination before they can bring those claims to Court. Because they did not supplement their EEOC charges to include this additional discrete act, they did not satisfy the exhaustion requirement.
