Rougier ruled that it was was beyond reasonable doubt

In a civil case? Surely this would be ultra vires - the burden of proof in civil cases is on the balance of probabilities )i.e. more probable than not), not beyond reasonable doubt (which is the burden in criminal cases).

Let me quote the obituary: "Although he was sitting in a civil court, Rougier ruled that "it was beyond reasonable doubt that Brookes had plainly murdered Lynn"."[1] -- !! ?? 23:36, 3 November 2007 (UTC)[reply]
