Pollution as Trespass
Has the concept of pollution as a form of trespass been developed? Conceiving trespass as unwelcome encroachment onto another's property, it seems clear that most forms of pollution are acts of trespass. Because trespass is objectionable, and pollution is a form of trespass, pollution is objectionable. Thanks! --Lbeaumont (talk) 19:35, 3 August 2019 (UTC)
- well, I guess that would depend greatly on where in the world you are. Not only is trespass defined in different ways in different legislations, but pollution, or the lack of it, are also differently enshrined in law. In England and Wales, for example there is a common law right to have water in any stream or river passing through your curtilage in its natural quality and quantity. In theory thefore pollution is actionable without any reference to trespass. Velella Velella Talk 19:48, 3 August 2019 (UTC)
