Non-free image use

This user feels that the images in question that were removed from this page do in fact fall under the terms of non-free use on Wikipedia and believes that the edit by User:Future Perfect at Sunrise should be respectfully reverted.

  • WP:NOT3RR What counts as exempt under NFCC can be controversial, and should be established as a violation first. Consider reporting to the Wikipedia:Non-free content review noticeboard instead of relying on this exemption. Legr0004 (talk) 09:01, 23 June 2011 (UTC)[reply]
    • It should also be noted that the images that were removed are unique in that their subject is liable to change - due to the nature of sites and the objects within the photographs - as visitors to the sites are known to move the artifacts around and the sites are susceptible to various forms of vandalism [1]

I was asked to comment on the usage of the non-free images. Wikipedia:Non-free content criteria states that non-free images cannot have a free equivalent and that the images are essential to understanding the article. The question is whether there is a free replacement for these images and whether they are needed for understanding the topic. The images are of a dive site, which can be accessed, and the submerged contents have not yet been destroyed, so free alternatives may exist(though unlikely). If the dive sites were permanently off-limits or destroyed, then no further free alternatives could be created (though older images could be released under a free license). As for whether they are essential, they don't illustrate the topic very well. File:Mariner_under_wing_Maritime_Heritage_Trail,_Saipan_Ships_of_Discovery.jpg shows a school of fish under a submerged wing...this is too narrow a scope to be considered necessary for the topic. I don't believe these images would qualify under fair-use on Wikipedia (this is my view and doesn't constitute legal advice). If you are affiliated with Ships of Discovery, you could release lower resolution images under a free license. When the images were originally uploaded this user was not familiar with just how strict the policy concerning the Non-free content was concerning specific use and detailed descriptions. The photographs were described to reflet various elements of the trail as a whole rather than specifics of the unique features which were to be acknowledged in the article itself. For example, the photograph which you reference above File:Mariner_under_wing_Maritime_Heritage_Trail,_Saipan_Ships_of_Discovery.jpg can be seen as being unique because it demonstrates a distinct, archaeologically significant feature of the Grumman PBM Mariner located on the trail. The bend in the wing, among other things helped to positively identify the airplane as a PBM Mariner. Due to the environmental conditions which these sites rest in (both natural and cultural); it is impossible to predict whether or not the features displayed in any of the images listed above will remain intact or not. The images were chosen to be shared / viewed freely in this popular free encyclopedia in hopes of increasing public attention and awareness to the significance of these sites for various reasons, one being in effort to prevent future human inflicted damage to the sites (or any other tampering) that would lead to premature deterioration of the sites, through education. The exchange of knowledge is one of the most powerful tools for preserving our past, and Wikipedia was founded with just that purpose: "to empower and engage people around the world to collect and develop educational content... in the public domain, and to disseminate it effectively and globally." - The images serve to enhance the article and create a better connection between the words on the page and the sites themselves. ◄ϻƴṮᶓῃ₵ 04:45, 24 June 2011 (UTC)[reply]

These images are unfortunately not in the public domain. As such, there are strict rules about using non-free images...even if the copyright holder does permit their use solely on wikipedia, the images must still meet non-free criteria. In this case, they do not as free images can still be made (until the area is destroyed/no longer accessible), or that the images are essential for understanding the article...this doesn't appear to be the case. However, it's my understanding that much of PBIF's information has been moved to other places (since pbif.org was shut down). If someone knows the new location of the info that was formerly at that URL, you might want to re-add this entry w/ the new location.

Off topic content

An “Off topic” template has been added to the section entitled “Marine Protected Areas” because the article states that the maritime heritage trail is only associated with one of the listed marine protected areas. It would be appropriate to relocate the content about marine protected areasto a more specific article and integrate content about the Mañagaha Marine Conservation Area elsewhere within the article.
