N145TT Crash

On January 5, 2022, a Cessna 402B aircraft registered as N145TT, operated by Airway Air Charter, crashed into the sea off Chub Cay, Berry Islands, shortly after departing from Miami-Opa locka Executive Airport, FL (OPF/KOPF). The aircraft was destroyed, but the two occupants were rescued and survived the crash. A lawsuit was filed by passenger Richard C. Murphy III and his wife, Kathleen, alleging negligence after the plane ran out of fuel and crashed into the ocean. U.S. District Judge Beth Bloom denied Noble Air Charter's motion to dismiss the lawsuit, stating that the liability waiver cited by the company and pilot Alex Gutierrez could not be enforced under the Warsaw Convention. The lawsuit claims Murphy sustained spinal fractures in the crash.[12][13]

N900CR Crash

On October 18, 2017, a Cessna 402B aircraft registered as N900CR, operated by Airway Air Charter, crashed while landing in Pinellas County, south St. Petersburg, FL. The aircraft was on a flight from Tallahassee, FL (TLH) to Sarasota, FL (SRQ). Both occupants survived the crash with no fatalities. The aircraft, manufactured in 1978, sustained damage during the landing phase of the flight.[14][15]

Bankruptcy

On June 21, 2024, Airway Air Charter filed for Chapter 11 bankruptcy protection in the Southern District of Florida. The filing cited financial difficulties and aimed at restructuring the company's debts to continue operations. The case was filed under the case number 1:2024bk16200 and is being presided over by Judge Robert A. Mark.[16][17][18]
