I felt it was necessary to create this category for several reasons. One is the self-evident importance of the topic. Another is that other categories were acting as (very poor) proxies for this category. So, for example, in cases having to do with implied causes of action, the Civ Pro category was used instead of this one. While Civ Pro makes a kind of sense (if there's no cause of action, the complaint is dismissed for failure to state a cause of action under R. 12(b)(6)), it was also highly inadequate. There were other reasons, too, but I figure I've sufficiently bored anyone who's read through this comment. Hydriotaphia 00:00, 15 March 2007 (UTC)[reply]
