Summary
DescriptionFlashComicsAshcan.jpg
English: One of the few remaining ashcan copies of Fawcett's proposed Flash Comics, featuring Captain Thunder (later published as Captain Marvel in Whiz Comics number 2). An ashcan copy is a publication produced solely for legal purposes (such as copyright), and not normally intended for distribution. In this case, Fawcett failed to secure the copyright, as All-American had already published a book under the same title.
Some of the artwork was later used in Whiz Comics number 3 (March 1940, page 14). This image is assumed to be in the public domain due to lapsed copyright.
English: Since this comic book was first published in the U.S. before 1964, the original copyright lasted 27 years from the end of the year of first publication. The copyright holder was free to renew the copyright any time during the year 1967, but they did not do so. (All copyright renewals after 1977 can be searched online here.) The copyright has expired.

This work is in the public domain because it was published in the United States between 1929 and 1963, and although there may or may not have been a copyright notice, the copyright was not renewed. For further explanation, see Commons:Hirtle chart and the copyright renewal logs. Note that it may still be copyrighted in jurisdictions that do not apply the rule of the shorter term for US works (depending on the date of the author's death), such as Canada (70 years p.m.a.), Mainland China (50 years p.m.a., not Hong Kong or Macao), Germany (70 years p.m.a.), Mexico (100 years p.m.a.), Switzerland (70 years p.m.a.), and other countries with individual treaties.
